Please take the time to read through these Terms of Service. By submitting a project deposit, clients agree to abide by these terms and conditions, even if they have not read them.
All clients must submit a Project Questionnaire to have their project considered, whether for website/blog design or for any other services offered (Website/Blog design Questionnaire / Logo design Questionnaire). Please fill this out thoroughly and thoughtfully. The purpose of this questionnaire is to help us determine what the scope of the project is and whether the project is a good fit for our services.
Payment & Refunds
A minimum downpayment of 30% is required for any website/blog or logo design. The downpayment is required before the project is placed in the design queue. Due to the nature of the services provide, this downpayment is non-refundable.
Only after the project is accepted, and deposit payment has been made, will the project will be placed on the queue. At that time, the client will be emailed with the project start date.
If your job is a ‘rush job’, please be advised that a rush fee will apply.
Website/Blog Design Revisions
Each website/blog design includes up to three different mockups. Each logo design includes up to 3 different concepts. After reviewing the first mockup/concept (and, if necessary, each additional mockup/concept, up to 3), the client will submit specific feedback, including every change that should be made. Additional mockups/concepts will be done at an hourly rate of $75/hr, and changes to the design after final approval will incur further charges.
Communication is key to the successful completion of any project. The preferred methods of communication are Skype (text chat only) and email. Almost all communication is via e-mail or Skype and not by phone, fax, postal mail or in person.
Clients are asked to respond in a timely manner to emails and chats, realizing that extensive delays in responding will extend the time of the project and possibly interfere with other projects. If client fails to communicate in 36 hours without warning, the project will be recycled back into the queue. If a client repeatedly fails to follow through with communication, client will forfeit his place in the queue.
If the clients situation changes, and there is a need to put the project on hold, the estimated price will be locked for 30 days from the estimated start date. After 30 days, it may be necessary to reassess the clients project if rates have changed. If the client decides not to proceed, all deposits are forfeited. Any graphics, layouts, concepts or mock-ups will remain the property of Archer Creative and may be resold or redistributed as necessary.
The client is responsible for providing the usernames and passwords for FTP access and any other login information and passwords necessary to access the client’s website. All usernames and passwords are kept in the strictest confidentiality, but all clients are encouraged to change their passwords after the completion of the project.
Copyright for all custom graphics is transferred to the client upon delivery. For website/blog designs, our design credit must be kept in the footer as long as the design is used. Purchase of a website/blog design is for a single domain; therefore, the custom theme, as a whole or in part, may not be used on another domain. All work done by Archer Creative may not be used by anyone else but the specified client on the domain for which it was originally designed. All preliminary mockups and concepts to include graphics, layouts, etc., which are not selected by the client remain the full property of Archer Creative and may be used in future projects for other clients.
Another designer may not make changes to the custom theme design client has purchased without permission from Archer Creative.
When clients provide artwork, graphics, or photos for use on their site, Archer Creative requires that the client has the license to use it. This means that it must be a royalty-free stock image or custom designed artwork where the original illustrator, photographer or artist has given the client permission to use their work on the client’s site.
Custom theme designs are designed to be compatible with current versions of IE, Firefox, Safari and Chrome. Clients are responsible for running the most current version of the preferred browser before the design process begins.
Blogger to WordPress Migrations
Please be aware that, while all posts can be imported from Blogger into WordPress without a problem, comments may not always import completely. Feedburner origin feed address will be updated for, and redirects will be set up for Blogger feeds, but there is no guarantee that Feedburner subscriber counts will not change.
After the site has been turned over to the client, the client will receive support via email for 30 days. We encourage our clients to use this time to load products and process several test entries to become familiar with the site’s functionalities. After 30 days, there could be a charge for hourly support, depending on the frequency and complexity of the client’s questions. Our hourly rate is $65. If client requires assistance after the hours of 5pm or on the weekends, please know that the hourly rate will be billed at $75.00.
Clients understand that their website/blog and logo designs and graphics may be used in our portfolio or other promotional material.
